What Are My Debt Collection Rights?
The Internal Revenue Service affords taxpayers many rights in the tax debt collection process. Below is a list of many of the rights taxpayers provided by the IRS.
•IRS employees will explain and protect a taxpayer’s rights throughout all contacts with the IRS.
•The IRS will not disclose to anyone the information given to the IRS by a taxpayer or their council, except as authorized by law. Taxpayers have the right to know why how the information will be used, and what happens if the requested information is not provided.
•Taxpayers have the right to either represent themselves of with proper written authorization, have someone else represent their case. The representative must be a person allowed to practice before the IRS, such as a tax lawyer, certified public accountant, or enrolled agent.
•Taxpayers have the right to have some one accompany them to interviews with the IRS representatives. They can also make audio recordings of any meetings with representatives.
•If a taxpayer disagrees with the IRS on the amount of a tax debt liability or certain collection actions the IRS takes, they have the right to ask a court or the IRS Appeals Office to review the case.
•If a taxpayer can show they acted reasonably and in good faith or relied on the incorrect advice of an IRS employee they can request the IRS waive all penalties that have been assessed on their income tax debt.
